Another round of negotiating sessions with Treasury Board has just been agreed upon. The PA group will be meeting the week of April 21, the other four TB units, EB, FB, SV and TC, will be meeting the week of April 28.

PSAC exchanged bargaining demands electronically with Treasury Board on April 27, 2007 and the teams will have their first meeting with the employer in mid-May. Read the latest Bargaining INFO and check out the package of demands for each of the TB bargaining units.
The Public Service Labour Relations Board ruled on July 7, 2006 that a firefighter fitness test adopted and implemented by the Department of National Defence is discriminatory on the basis of age and sex.
The Board's adjucator also directed the employer "to immediately cease using the eight minute standard as a condition of employment for DND firefighters”.
Two PSAC members had filed a grievance against National Defence in 2002 on the basis that it was discriminatory against older and women firefighters. The test, introduced in 2000, became compulsory in July 2002; firefighters had to complete the fitness test in eight minutes as condition of employment. Failure to participate in the test was the subject of administrative and disciplinary action.
The Union of National Defence Employees (UNDE) fought the implementation of the test and several PSAC/UNDE members refused to take the test. No less than 327 grievances were filed by PSAC/UNDE members to oppose the implementation of the test as a condition of employment at DND.

Following the signing of the Table 2 collective agreement in March, the PSAC became aware of a number of issues which required interpretation, and some errors that needed correction. We raised these issues with the Employer and agreed to negotiate a number of amendments to the collective agreement to clarify the intent.

The PSAC and Treasury Board signed the Operational Services (Table 2) agreement on Tuesday, March 22. All changes to the collective agreements take effect on date of signing, unless otherwise specified.
The government has 150 days from the date of signing, i.e. until August 19, to implement the retroactivity. However, Treasury Board has indicated they intend to move quickly to implement the new rates of pay and any retroactive pay that that does not have to be calculated manually.
Compared to the other Treasury Board agreements, it took a few extra days to prepare the Table 2 agreement for signing, primarily because of delays on the employer's side. The PSAC had provided detailed comments on a first draft on February 24, but did not get a revised draft from the employer until March 11. Since then, we have reviewed three more drafts. In the process, we have corrected some 30 errors in the 400-page agreement.

The Public Service Alliance of Canada (PSAC) will be signing collective agreements with Treasury Board for over 100,000 of its members, removing the threat of a recurrence of the country-wide strikes that took place last summer and fall. Read the release
Now that the agreements and final offers have been accepted by the members, the collective agreements will be prepared for signing. The full collective agreement is carefully reviewed by the union to ensure that it reflects the tentative settlement or final offer. PSAC will be pushing for the earliest possible signing date for these collective agreements. Once the signing dates are fixed, this information will be published on the web site, sent to the e-mail lists and included in the Union Update.

The Federal Court (Trial Division) has allowed PSAC's judicial review against a decision by the Canadian Human Rights Commission not to deal with one of our complaints. Read the latest pay equity Bulletin.
The PSAC's challenge of the government's practice of taxing the interest payments received as part of the pay equity complaint settlement is being heard starting January 18 and continuing until January 20, 2005. The hearings are open to the public. They will be taking place in Ottawa at 200 Kent Street, 3rd floor, starting at 9:30 a.m.
